Clearview Landscape Services — Terms of Service

These Terms govern your use of our website, mobile app, communications, and landscape services. By requesting services, accepting an estimate, or allowing us on your property, you agree to these Terms. Please read them carefully.
1. The Service
Clearview provides professional lawn care, landscaping, and grounds maintenance in southeastern Wisconsin. Specific work is governed by the estimate or service agreement you accept.
We may reschedule or adjust services due to weather, safety concerns, or events beyond our reasonable control (including extreme heat/cold, heavy rain, snow, or other force majeure events). In such cases, we will notify you as soon as practicable and work with you to reschedule at no additional penalty.
2. Accounts
You must be 18 or older. You are responsible for keeping your account information accurate and your login credentials secure.
3. Payments & Billing
Invoices are due as stated. We use a secure payment processor. Late payments (more than 30 days past due) may incur a 5% late fee plus interest at the maximum rate allowed by Wisconsin law. You are also responsible for reasonable collection costs. We may suspend services, place a lien where permitted by law, or pursue collection for unpaid balances.
Payment Disputes & Chargebacks. Once work is completed and invoiced, you agree not to initiate chargebacks or disputes with your payment provider for reasons other than clear billing errors. Any dispute must first be brought to us in writing so we can address it directly.
4. Your Responsibilities at the Work Site
To ensure safe and effective service:
- You must contact 811 before any digging or ground disturbance and mark or disclose all private utilities (sprinklers, invisible fences, low-voltage lighting, septic lines, etc.).
- Please move vehicles, furniture, decorations, and other valuables away from work areas.
- Keep pets, children, and others out of the work zone and notify us of any aggressive animals or hazards.
- Provide clear access using any codes or instructions you share.
If these steps are not followed, we may skip affected areas, reschedule, or still charge the full agreed price for the visit (including a reasonable trip charge for failed visits due to access issues). You agree to indemnify and hold Clearview harmless from any claims, damages, or costs arising from your failure to meet these responsibilities.
Cleanup Standards. Our crews perform standard cleanup after each visit. Grass clippings, leaves, and minor debris are managed according to industry norms for the service performed. You understand that some debris is inherent in lawn care and we are not responsible for every individual blade or leaf.
5. Warranty
We warrant our workmanship for one year from completion (excluding living plants, sod, seed, and mulch, which are subject to customer maintenance and external factors). To make a claim you must notify us in writing within 30 days of discovering an issue and give us a reasonable opportunity to inspect and remedy it. This is your sole remedy. The warranty does not cover weather, pets, customer maintenance, disease, pests, or normal wear.
Customer Maintenance Obligations. For any installed plants, treatments, or seeded areas, you agree to follow our reasonable care instructions (including regular watering, mowing at proper heights, and avoiding foot traffic during establishment). Failure to do so voids any related warranty coverage.
6. Photo & Video License
By hiring us or uploading photos, you grant Clearview a perpetual, royalty-free license to use images and videos of the property and our work for business and marketing purposes. We will obscure recognizable faces, license plates, and identifying details. You may opt out of promotional use of specific photos by notifying us before publication.
7. Communications & SMS Program Disclosure
You consent to service-related texts, calls, and emails. Marketing messages can be opted out of at any time. Transactional messages about your account and scheduled work continue while your account is active. Calls placed through our platform may be recorded for quality, training, and dispute resolution.
SMS / Text Messaging Program (A2P 10DLC)
Program name: Clearview Customer Communications, operated by Clearview Landscape Services LLC.
How you opt in. You opt in to receive text messages from Clearview by checking an SMS-opt-in box on our website or estimate-request form, by enabling SMS notifications in the Clearview mobile app, by providing your mobile number on a signed proposal that includes an SMS-opt-in acknowledgement, or by texting a keyword (for example JOIN or START) to our program number. Each opt-in surface discloses the program name, message types, frequency, that message and data rates may apply, that consent is not a condition of purchase, the STOP/HELP keywords, and links to this Terms of Service and our Privacy Policy. We retain a record of each opt-in (method, timestamp, and the version of these Terms in effect) for compliance with the federal Telephone Consumer Protection Act (TCPA) and applicable state law.
Message types.
- Service / transactional: appointment confirmations, on-the-way and arrival notices, estimate / invoice / payment-receipt deliveries, weather-related schedule changes, reschedule requests, completion follow-ups, and account-security messages (password reset, login verification).
- Marketing (only if you separately opt in): seasonal promotions, service reminders, and news.
Message frequency. Service / transactional messages are typically 2–8 messages per month during active service, higher around the start or completion of a project; there is no fixed cap because these are tied to real-time service events. Marketing messages, when separately opted in to, are typically no more than 4 messages per month.
Message and data rates may apply. Your wireless carrier determines those rates; Clearview does not collect or charge any fee for the messages themselves.
HELP. Reply HELP to any Clearview text, email [email protected], or call (262) 333-3676 for assistance.
STOP / opt-out. You may stop receiving texts at any time by replying any of STOP, QUIT, END, CANCEL, UNSUBSCRIBE, REVOKE, or OPT OUT to any Clearview text. You may also revoke consent by emailing [email protected], calling (262) 333-3676, turning off SMS in the Clearview mobile app under Settings → Notifications, or mailing written notice to Clearview Landscape Services LLC, P.O. Box 283, Menomonee Falls, WI 53052. We honor opt-outs promptly — within ten (10) business days, as required by FCC rules. You may receive one final confirmation text after opting out. Opting out of SMS does not cancel your account, email notifications, or any ongoing service — it only stops texts.
Consent is not a condition of purchase. You can buy any landscape service from Clearview without ever opting in to SMS.
Age. You must be at least 18 years old and the account holder or authorized user of the mobile number you provide.
Carriers. Our SMS program is delivered through Twilio Inc. over major U.S. wireless carriers, including AT&T, T-Mobile, Verizon, U.S. Cellular, and their MVNOs. Supported carriers are not liable for delayed or undelivered messages. Message delivery is subject to carrier availability and any restrictions imposed under the A2P 10DLC registration system.
Privacy and information sharing. Clearview's collection, use, storage, and sharing of information related to the SMS program — including your mobile phone number, message content, and opt-in / opt-out history — is described in our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors (such as Twilio for message delivery) in support of the services for which you opted in is permitted and disclosed in our Privacy Policy.
8. Recurring Services, Cancellations & Changes
Recurring Service Agreements. You may cancel a recurring agreement with 30 days' written notice. Cancellation takes effect at the end of the current billing cycle; you remain responsible for all visits already completed or scheduled. Early cancellation of a seasonal or annual agreement may result in a reasonable termination fee to cover scheduling and preparation costs (not to exceed one month's service value).
Change Orders & Additional Work. Any additional services requested on-site must be agreed upon in advance (via estimate, text, or app). We reserve the right to decline or reschedule if the added work would affect safety, timing, or crew capacity.
9. Limitation of Liability
To the maximum extent permitted by law, Clearview's total liability will not exceed the greater of $2,500 or the amount you paid us in the prior 12 months. We are not liable for indirect, consequential, or punitive damages.
10. Dispute Resolution
We encourage you to contact us first so we can resolve issues together. Any unresolved dispute will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Rules. You waive the right to a jury trial and to participate in any class, collective, or mass action. This section survives termination. You may opt out of arbitration within 30 days of first accepting these Terms by emailing and mailing notice to the address above. Full details are available upon request.
11. General Provisions
These Terms are governed by Wisconsin law. We may update them with notice. If any provision is held invalid, the remainder remains in effect.
